Our Commitment to Your Privacy

At Hummingbird Pediatrics, we understand that your child's medical information is personal and private. We are committed to protecting the privacy of your child's health information and complying with all federal and state privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA).

Example: Different departments of our practice may share your child's medical information to coordinate their care, such as prescriptions, lab work, and x-rays.

We may use and disclose your child's medical information to bill and collect payment for services we provided. This may include submitting claims to your health insurance company.

Example: We may send information about a diagnosis and treatment plan to your health insurance company to get approval for payment.

We may use and disclose your child's medical information for healthcare operations necessary to run our practice and ensure quality care for all our patients.

Example: We may use medical information to review our treatment and services and to evaluate the performance of our staff in caring for you.

Appointment Reminders

We may use and disclose medical information to contact you to remind you about appointments or to inform you about treatment alternatives or other health-related benefits and services that may be of interest to you.

Business Associates

We may disclose your child's health information to third-party business associates who perform services on our behalf. These include:

  • Patient portal services (InteliChart)
  • Email notification services (Resend)
  • Database hosting providers (Neon)
  • Website hosting and deployment (Replit)
  • Analytics and mapping services (Google)

All business associates are required to sign agreements to protect your child's health information and comply with HIPAA regulations.

Other Permitted and Required Uses

We may also use or disclose your child's health information without your authorization in the following situations:

  • When required by law
  • For public health activities (e.g., reporting diseases, injuries, births, deaths)
  • To report suspected abuse, neglect, or domestic violence
  • To health oversight agencies for authorized activities
  • In response to court orders or lawful subpoenas
  • To law enforcement for specific law enforcement purposes
  • To coroners, medical examiners, and funeral directors
  • For organ and tissue donation purposes
  • To avert a serious threat to health or safety
  • For workers' compensation programs

Parental Access to Your Child's Medical Records

As a parent or legal guardian, you generally have the right to access your child's medical records. However, there are some important exceptions:

  • Emancipated or Mature Minors: In New Jersey, minors who are married, on active military duty, or determined to be emancipated may control their own medical information.
  • Confidential Services: New Jersey law allows minors to consent to certain services without parental consent, including:
    • Reproductive health services
    • Mental health and substance abuse treatment (age 14+)
    • Testing and treatment for sexually transmitted infections
  • Court Orders: In cases where a court has limited parental rights or appointed a legal guardian, access may be restricted.

We will always respect the legal rights of minors while maintaining open communication with parents whenever appropriate and permitted by law.

Your Rights Regarding Your Child's Medical Information

Right to Inspect and Copy

You have the right to inspect and obtain a copy of your child's medical records. Under New Jersey law, we must provide copies within 30 days of your request. We may charge a reasonable fee for copying costs.

Right to Request Amendments

If you believe your child's medical information is incorrect or incomplete, you may request that we amend the information. We may deny your request under certain circumstances, but we will provide you with a written explanation.

Right to an Accounting of Disclosures

You have the right to request a list of certain disclosures we made of your child's medical information for purposes other than treatment, payment, or healthcare operations.

Right to Request Restrictions

You have the right to request restrictions on how we use or disclose your child's medical information. We are not required to agree to your request, but if we do, we will comply with the restriction unless the information is needed for emergency treatment.

Right to Request Confidential Communications

You have the right to request that we communicate with you about your child's medical matters in a certain way or at a certain location. For example, you may ask that we only contact you at work.

Right to a Paper Copy of This Notice

You have the right to receive a paper copy of this Notice at any time, even if you previously agreed to receive it electronically.

Right to Notification of a Breach

You have the right to be notified if we discover a breach of your child's unsecured protected health information. We will notify you without unreasonable delay and no later than 60 days following discovery of the breach.

Changes to This Notice

We reserve the right to change this Notice at any time. Any changes will apply to all protected health information we maintain. When we make a significant change to our privacy practices, we will revise this Notice and post the new Notice in our office and on our website. You may obtain a copy of the current Notice at any time by contacting our office.

How to File a Complaint

If you believe your privacy rights have been violated, you may file a complaint with our practice or with the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint.
